Mr. Maione has broad experience representing financial institutions such as banks, securities clearing and transfer companies, broker-dealers and other commercial enterprises as both plaintiff and defendant in civil litigation, arbitration, and administrative proceedings. Included in these matters have been both jury and non-jury matters in New York and New Jersey, as well as in federal district courts in New York, New Jersey, Massachusetts, Pennsylvania, California, Washington State, Texas, Maryland, Washington, D.C., Colorado, Oklahoma, Connecticut, and the U.S. Virgin Islands. He also has tried cases in other state courts such as Massachusetts, Maryland, and Florida when admitted specifically for that matter.
Commercial and Business Litigation
Mr. Maione has experience in a wide array of corporate commercial matters including, dissolution of corporations and limited liabilty companies, disputes between shareholders, foreclosures, breach of contract, breach of fiduciary duty between law partners, Will disputes, tradedress litigation, disputes of ownership of securities between contending bona fide purchasers for value, churning and unsuitability cases by brokers, and enforcement proceedings against brokers, in addition to products liability and emloyment and Whistleblower matters (See Blog), including CEPA. Mr. Maione has represented both individual plaintiffs and corporate defendants in foreclosure matters, as well as discrimination matters involving sex, gender, disability, and age, as well as under the federal Fair Labor Standards Act, the Carmack Amendment and both the Warsaw and Montreal Conventions. In addition, his business experience as CEO in leading a major innovator in the cancer diagnostic industry gives him the unique advantage of understanding business operations on a granular basis, as well as the legal needs of his clients. Mr. Maione has represented both corporations and individuals in investigations by the Office of the Inspector General, the Department of Justice, the Department of the Navy, and the New York State Departments of Banking and Insurance. Together with local criminal counsel, Mr. Maione successfully recovered more than $9.5 M from the State of Arizona in a forfeiture action while successfully representing Swiss and German nationals defrauded in an international Ponzi scheme.
Securities Litigation and Arbitration
Mr. Maione has represented major banks as well as securities transfer and clearing corporations in connection with the transfer and/or sale of securities; and, individual foreign nationals defrauded in the purchase of securities, including Ponzi schemes and “Prime Bank Guarantee” frauds. Mr. Maione also has represented brokers in NASD/FINRA, New York Stock Exchange arbitrations and SEC enforcement proceedings, as well as major brokerage firms in arbitrations against rogue brokers. Mr. Maione has served as a Neutral with the American Arbitration Association and, because he thoroughly understands the arbitration process, has been successful in arbitrating on behalf of his clients.
